Native American Miners Should Be Receiving Workers Compensation Benefits
For decades, Native American miners have worked the mines of the Colorado Plateau. The mining process requires the use of a drill to excavate yellow, soft uranium ore from these rocks. The uranium that thousands of American Indians dug from the earth went into nuclear warheads credited with helping America win the Cold War. This site teaches you about workers compensation lawyer.
Unfortunately, a great number of these miners were also injured by this uranium mining process. Radiation in the uranium mines has caused the miners a variety of health problems, such as cancer and other illnesses caused by exposure; many have even died. Survivors continue a daily battle for life, and many have had to bury family and friends.
Most the the workers who are still alive need to undergo regular dialysis treatment, and have arms covered with scars. Since kidney failure is a pervasive component of their failing health, the dialysis is a necessary part of their lives. In 1990, U.S. Congress passed the Radiation Exposure Compensation Act. The purpose of this law was to help uranium miners and others who have suffered and continue to suffer as a result of the mining work undertaken. Under the provisions of the law, every underground uranium miner is entitled to $100,000. The condition being that they experience one of six lung diseases linked to radiation exposure. Countless miners of American Indian descent still have not been compensated, despite being eligible.
Indian miners find that they are confronted with hurdles that are nearly impossible for them to overcome. The first step is the most difficult and requires them to fill out paperwork written in English. Written English is not a strength with these American Indian miners.
Only 96 miners have been approved for compensation out of the 242 that have applied through the Office of Navajo Uranium Workers. Overall 1,314 former uranium mines claims have been approved by the Justice Department. Another 1,316 miners' applications have been denied.
A worker is required to provide check stubs for a record as proof of working there, plus more documentation is required to prove the specific amount of time the worker spent in the mines. Most of the workers who have been in the mines for decades don't keep those kinds of records for their work. These records are even more troublesome to get a hold of later on.
The uranium mines first opened on and around the Navajo Indian Reservation in 1947. During this period, the Navajo were glad to see an opportunity for employment. Poor working conditions and low wages involved in the jobs did not lessen the welcoming of the work.
At that time radon was one of the greatest dangers in those mines. Radon is a colourless, odourless radioactive gas created by decaying uranium. The government provides compensation to these miners because the lung diseases that most are suffering from is caused by radon exposure.
The current plan this fall is for former miners and tribal officials to lobby Congress to make changes in this compensation law to clear the way for these former miners to receive the payments due. The government's biggest concern is that many miners feel that they deserve compensation simply because they worked in the mines, rather than due to the illness and disease they acquired as a result of that work.
